Quikly, Inc. (“Quikly”) is a company that administers time-based promotional campaigns (“Quikly Campaigns”) on behalf of businesses. A Quikly Campaign gathers personal data from individuals who choose to participate and data regarding the Quikly Campaign itself. Quikly takes its privacy obligations seriously, both to its clients and to people who enter Quikly Campaigns. This policy outlines our treatment of personal data we collect on behalf of our clients and for our own use.

Quikly operates Quikly Campaigns on behalf of its clients. Quikly acts as a data processor and/or service provider on behalf of such clients. Each of our clients is the data controller for the data they collect within the applicable Quikly Campaign and is the sole owner of that data. Our client for a Quikly Campaign is often referred to as the promotion sponsor. As part of our services, Quikly collects personal data for clients by use of Quikly's proprietary online technology and points of entry offline. Quikly collects such personal data solely for the use of the applicable client and the operation of the Quikly Campaigns. Uses within a Quikly Campaign may include notification of potential winners, fulfillment of prizes, and marketing analysis. Quikly strictly limits access to personal data within its organization. Data is not shared outside of the company except that Quikly provides data to our clients, to third parties if directed by our clients, and in response to appropriate governmental or legal requests. Personal data collected from a Quikly Campaign is never shared with any client other than the client on whose behalf the information was collected. Personal data collected by Quikly on behalf of a client belongs solely to the client and will be used solely in accordance with that client's privacy policy. You have the right to access your personal data in our Quikly Campaigns by contacting the client of ours that collected your data. That client can inform you of how they use, disclose, and limit your personal data, as well as your choice to opt out of its collection, amend it for accuracy, or have it deleted. Quikly is not responsible for data collected on behalf of clients when it is in a client's possession.
Quikly may run Quikly Campaigns on its own behalf. Such Quikly Campaigns are to generate interest from other businesses in Quikly's products and services. Quikly uses personal data collected in such Quikly Campaigns as sales leads and may contact the individual registrants by email, mail or phone. Quikly will never sell such information or share it with another business. When individuals opt in to receive information from Quikly, they agree to receive email and other notices from Quikly, including marketing messages, surveys, special offers and notices about other Quikly Campaigns. Such notices may come from Quikly itself or from Quikly on behalf of companies with whom Quikly has a business relationship. If you want to opt out of being contacted by Quikly after you have participated in a Quikly Campaign operated by us directly, or you wish to correct the information you have provided to Quikly, you may do so in one of two ways: (1) mail the details of your request to: Privacy Policy c/o Quikly, Inc. 1555 Broadway St., 3rd Floor, Detroit, MI 48226; (2) email to hello@quikly.com. Please make sure to include the name of the Quikly Campaign (if one exists) in the subject line and in the body of the email from which you wish to opt-out. Failure to provide this information may delay the processing of your request.
Quikly's proprietary technology has the ability to collect data other than personal data for any of the Quikly Campaigns it operates. Quikly may collect information about your computer or device configuration such as your browser type, site visit information, or the operating system. Quikly may collect information about the site you last visited prior to the Quikly Campaign or about your activity during your visit to the Quikly Campaign site. Quikly may also offer social sign-on services that allow you to register for a Quikly Campaign using a third-party social networking site such as Facebook, Google, or Twitter. By using these services, you allow Quikly to access the available information from your third-party social network profile such as your name, age, gender, location, email address, and list of friends. This information may be used by Quikly to administer the technical and operational aspects of the site. Your IP address may also be used to gather broad demographic information for aggregate use.
Many Quikly Campaigns can be accessed via mobile technology. Quikly operates portions of the mobile aspects of Quikly Campaigns on behalf of its clients. As part of those mobile services, Quikly collects personal data by use of Quikly's mobile technology. Quikly will not collect personal data from you without your consent. We will use reasonable efforts to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data under our control, including physical, electronic and procedural safeguards. However, due to the nature of mobile communications, we cannot guarantee the security of any data transmitted through mobile messaging. Quikly will only use the information you provide, including your mobile number, to send you content pursuant to the Quikly Campaign in which you have requested to participate; though we will share the information we collected from you with the client on whose behalf we collected it. We will not use your information for any other purpose. Quikly is not responsible for information collected on behalf of its clients when such information is in its client's possession. However, we reserve the right at all times to disclose any information as necessary to satisfy any law, regulation, or governmental request; to avoid liability; or to protect our rights or property. When you provide us information in connection with a mobile program, you agree to provide accurate, complete and true information. You agree not to use a false or misleading name or a name that you are not authorized to use. If we, in our sole discretion, believe that any such information is untrue, inaccurate or incomplete, we may prohibit you from further participation in the applicable program and pursue any appropriate legal remedies.
We collect information about you when you participate in a Quikly Campaign, including browsing our websites and taking certain actions within the Quikly Campaign, such as registration.
Content you provide through our websites: The Quikly Campaign related services include the websites and other media operated by us on behalf of clients. We collect content that you submit to these websites, which may also include social media or social networking websites operated by us. For example, you provide content to us when you provide feedback or when you participate in any interactive features in a Quikly Campaign.
Information You Provide Through Our Support Channels: Our services also include customer support, where you may choose to submit information regarding a problem you are experiencing with a Quikly Campaign. You may be asked to provide contact information, a summary of the problem you are experiencing, and any other documentation, screenshots or information that would be helpful in resolving the issue.
Your Participation in a Quikly Campaign: We collect certain information about your site visit and interaction with a Quikly Campaign. This information includes the personal data you provide upon registration; the links you click on; and how you interact with a Quikly Campaign
Device and Connection Information: We collect information about your computer, phone, tablet, or other devices you use to access a Quikly Campaign. This device information includes your connection type and settings when you access a Quikly Campaign site. We also collect information through your device about your operating system, browser type, IP address, URLs of referring and exit pages, device identifiers, and crash data. We use your IP address and to approximate your location to provide you with a better Quikly Campaign experience. How much device information we collect depends on the type and settings of the device you use to participate in a Quikly Campaign.
Location Information: We may receive information about your location. For example, you may enter address information upon registration into a Quikly Campaign. We may also determine location by using other data from your device, such as information about wireless networks or cell towers near your mobile device, or your IP address. We may use and store information about your location to provide features of our Quikly Campaign and to improve and customize our services.
Links: We may keep track of how you interact with links across a Quikly Campaign, including email notifications, third-party services, and client applications, by redirecting clicks or through other means. We do this to improve our Quikly Campaign services, to provide more relevant experiences, and to be able to share aggregate statistics and analytics to our clients, such as how many times a particular link was clicked on.
Cookies and Other Tracking Technologies: Quikly uses browser cookies in order to improve the user experience by enabling our Quikly Campaigns to “remember” you or your preferences, either for the duration of your single visit to a website (using "session cookies") or during additional visits ("persistent cookies"). A cookie is a small text file that is stored on your computer or device by a website. Only the visited website will be able to read the contents of a particular cookie. Every cookie is unique to your web browser and contains anonymous information such as a unique identifier, the site name, and some digits and numbers. Cookies serve different purposes, such as letting the user navigate between pages efficiently, storing user preferences or settings, and overall improving an experience with our Quikly Campaigns and sites. Cookies make the interaction with a Quikly Campaign easier. Some of our sites will also use cookies or web analytic tracking methods to enable targeted advertising or marketing messages based, for example, on your location and/or browsing habits. Cookies may be set by the website domain you are visiting ("first party cookies") or they may be set by other website domains that run content on the page you are viewing ("third party cookies"). The content of third party cookies can sometimes include Facebook "like" buttons or Twitter "tweet" buttons. Although most web browsers automatically accept cookies, some browsers’ settings can be modified to decline cookies or alert you when a website is attempting to place a cookie on your computer. However, some Quikly Campaigns may not function properly if you disable cookies. If you do not want to see advertising that has been targeted to your interests or activities, it is possible to block some or all cookies, or even to delete cookies that have already been set, but you might lose some or all of that website's functionality.

Log Data: We receive information when you view content on or otherwise interact with our Quikly Campaigns, which we refer to as “Log Data,” even if you have not registered. For example, when you visit our websites, interact with our email notifications, or visit a third-party site from a Quikly Campaign site, we may receive information about your visit. This Log Data includes information such as your IP address, browser type, operating system, the referring web page, pages visited, location, your mobile carrier, device information (including device and application IDs), search terms, and cookie information. We use Log Data to operate our services and ensure their secure, reliable, and robust performance. For example, we use Log Data to protect the security of accounts and to determine what content is popular on our Quikly Campaign sites. We also use this data to improve the content we show you, including ads.
Service Providers: Quikly works with third-party service providers to provide website and application development, maintenance, backup, storage, virtual infrastructure, analysis and other services for us, which may require them to access or use information about you. If a service provider needs to access information about you to perform services on our behalf, they do so based on instructions from us, including compliance with requirements and procedures designed to protect your information.

Affiliates and Change of Ownership: In the event that we are involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your information may be sold or transferred as part of that transaction. This Privacy Policy will apply to your information as transferred to the new entity. We may also disclose information about you to our corporate affiliates in order to help provide, understand, and improve Quikly Campaigns, our other services, and our affiliates’ services, including the delivery of ads.
Non-Personal Information: We may share or disclose non-personal, aggregated, or device-level information such as the total number of times people engaged with a Quikly Campaign, the number of users who clicked on a particular link, the number or types of entries in a contest, the characteristics of a device or its user, or aggregated or device-level reports to our clients about Quikly Campaigns. This information does not include your name, email address, phone number, or other personal data.
Quikly Clients: We may receive information about you from a client related to a Quikly Campaign with that client, in accordance with their terms and policies.
To Operate Quikly Campaigns and Personalize Your Experience: We use information about you to operate the Quikly Campaigns, including to process transactions with you, authenticate you when you log in, provide customer support, and operate and maintain the Quikly Campaigns. Our Quikly Campaigns may also include features that personalize your experience. We may use your email domain to ensure your eligibility or your affiliation with a particular organization or industry to personalize the content and experience you receive. Where you use multiple Quikly Campaign platforms (website, mobile website, mobile app), we combine information about you and your activities to provide an integrated experience, such as to allow you to engage from the various platforms we make available.
For Development and Improvement of our Quikly Campaigns and Services: We continually to make our Quikly Campaigns more engaging, secure, rewarding, and useful to you and our clients. We use collective learnings about how users engage with our Quikly Campaigns and feedback provided directly to us to troubleshoot and to identify trends, usage, activity patterns and areas for improvement.
To Communicate With You About The Services: We use your contact information to send transactional communications to you by email, text message, mobile app messaging, and other means to access a Quikly Campaign. We remind you of Quikly Campaign deadlines, respond to your comments, questions and requests, provide customer support, and may send you notices, updates, and administrative messages. We also provide personalized communications based on your activity and interactions with a Quikly Campaign. For example, certain actions you take in a Quikly Campaign may automatically trigger communications related to the Quikly Campaign engagement, such as go-live notifications or reward claims. Transactional communications are part of the Quikly Campaign and in most cases, you cannot opt out of them and continue to participate. If an opt out is available, you will find that option within the communication itself. Importantly, if you do enter into a Quikly Campaign and opt out of transactional communications, we will have no way to reach you if you are a potential winner or otherwise eligible for something of value. If you opt out of such communications, you will no longer be eligible as an entrant.
To Market, Promote, and Drive Engagement With The Services: If you opted in to receive such communications from Quikly, we will use your contact information and information about how you engage with Quikly Campaigns to send communications that may be of specific interest to you, including by email. These communications are aimed at driving engagement with our Quikly Campaigns, and may include information about new programs and sites we think may be of interest to you. We may also communicate with you about new product and service offers, promotions and contests. You can control whether you receive these communications as described below under "Opt-out of communications."
Customer Support: We use your information to resolve technical issues you encounter, to respond to your requests for assistance, to analyze crash information, and to repair and improve the Quikly Campaigns.
For Safety and Security: We use information about you and your Quikly Campaign participation to verify accounts and activity, to monitor suspicious or fraudulent activity and to identify violations of the Quikly Campaign rules or the policies of Quikly or our clients.
To Protect our Legitimate Business Interests and Legal Rights: We use information about you where you have provided consent for Quikly and our client to do so for a specific purpose not listed above. For example, with your consent and on behalf of our clients, we may post endorsements or other user generated content to social media platforms.

Information Storage and Security: We use data hosting equipment and service providers in the United States to host the information we collect, and we use technical measures to secure your data.
How Long We Keep Information: How long we keep personal data and other information we collect about Quikly Campaign participants depends on the type of information, as described below. After such time, we will either delete or anonymize the information or, if this is not possible, we will securely store your information and isolate it from further use until deletion is possible.
Quikly Campaign information: We retain the information about your participation in a Quikly Campaign for a reasonable period after the Quikly Campaign and all related services and requirements are completed. We also retain some of your information as necessary to comply with our legal obligations, to resolve disputes, to enforce our terms and rules, to support business operations and to continue to develop and improve our Quikly Campaigns and services. The length of time we retain information to comply with legal obligations is typically the length of the statute of limitations applicable to the types of claims that could be brought in association with a Quikly Campaign, including a reasonable period of tolling. Where we retain information for service improvement and development, we take steps to eliminate information that directly identifies you, and we only use the information to develop general insights about use of our Quikly Campaigns, not to analyze personal characteristics about any individual.
Marketing information: If you elect to receive marketing emails from Quikly, we retain information about your marketing preferences unless you specifically ask us to delete such information. We retain information derived from cookies and other tracking technologies for a reasonable period from the date such information was created.
Quikly acts as a data processor and/or service provider on behalf of its clients. Each of our clients is the data controller for the data they collect in the applicable Quikly Campaign and is the sole owner of that data.
The California Consumer Privacy Act (“CCPA”), as amended, the Colorado Privacy Act (“CPA”), the Connecticut Data Privacy Act (“CTDPA”), the Florida Digital Bill of Rights (“FDBR”), the Oregon Consumer Privacy Act (“OCPA”), Texas Data Privacy and Security Act ("TDPSA"), the Utah Consumer Privacy Act (“UCPA”), and the Virginia Consumer Data Protection Act (“VCDPA”) provide residents of their respective states with additional rights with respect to their personal data. For a list of the categories of information that we process, please see the chart in the Your California Privacy Rights section below; this applies to all U.S. residents, not just residents of California.
Depending on where you live and what you are asking us to do, we may or may not be obligated to comply with your request, and/or the time required to complete a request may vary. Based on how we collect and utilize your personal data, you may have the following rights:
Right to Access — You have the right to request that we provide you with a copy of the specific pieces of personal data we collected about you.
Right to Delete — You have the right to request that we delete your personal data that we maintain about you, subject to certain exceptions.
If you were known by another name or lived at another address, we may not be able to locate all information which relates to you if you do not include it in the form below. Please provide as much information as possible so that we can try to identify all records which relate to you. We may keep certain personal data in accordance with our legal obligations and rights, such as keeping sufficient information about you to recognize that you have made a personal data request and to keep a record of that request.
However, if we lawfully receive your personal data after fulfilling your deletion request, that new information may be included in future data products unless/until you submit a new deletion request. However, if one of our clients separately has your personal data and they provide it to us, along with specific instructions on how we are to use it on their behalf, you may still receive their advertising. (We do not add our clients’ data to our own data products unless allowed to by our clients)
Right to Opt-Out of Targeted Advertising — You have the right to request that we not include your data for any targeted advertising we conduct.
Your choices do NOT affect marketing that is not based on your personal data. For example, you may still receive advertising based on the content and predicted audience of the website you are browsing. This is known as “contextual advertising” and will not stop in response to your requests.
Right to Correct — You have the right to request that we correct inaccurate personal data that we maintain about you, subject to certain exceptions.
Right to Limit Use of Sensitive Personal Data — You have the right to request that we do not process or share your sensitive personal data.
Right to Opt-Out of Profiling — You have the right to request that we not process your information for profiling.
Right to Non-Discrimination — You have the right to not receive discriminatory treatment for the exercise of your privacy rights.
Do Not Sell/Share My Info — We do not sell your information to anyone. You can request that we not sell or share your personal data that we have in our products. For purposes of this Privacy Notice, “sell” means the sale of your personal data to an outside party for monetary or other valuable consideration, subject to certain exceptions set forth in applicable U.S. privacy laws. For purposes of this Privacy Notice, “share” means the targeting of advertising to you based on your personal data obtained from your activity across websites, subject to certain exceptions set forth in applicable U.S. privacy laws. Any opt-out of cookie-based tracking for advertising purposes is specific to the device, website, and browser you are using, and is deleted whenever you clear your browser’s cache.
In relation to these rights, you may contact us at hello@quikly.com. However, if Quikly collects your personal data on behalf of a client in connection with that client’s Quikly Campaign, your request should be directed to the client data controller. In most cases, we will in the first instance direct your request to our client, the data controller.
Notice: If you contact us regarding personal data collected in connection with a client Quikly Campaign for which we are a data processor, we will attempt to refer your request to the relevant client, which is the sponsor of the Quikly Campaign and the data controller. We are not responsible for responding to your request on behalf of the data controller and your request will be directed to the client only. We will process such requests only upon instructions from the data controller that is sponsoring the Quikly Campaign.
If Quikly is required to respond directly to your request, we may require proof of identity. We also reserve the right to charge a fee where permitted by law, especially if your request appears unfounded, excessive, or abusive. We will use reasonable efforts to respond to your request within all applicable timeframes. We may deny certain requests, or fulfill a request only in part, based on our legal rights and obligations. For example, we may retain personal data as permitted by law, such as for tax or other record keeping purposes, to maintain an active account, and to process transactions and facilitate customer requests.
This California Resident Privacy Policy disclosure (“Disclosure”) is provided pursuant to the California Consumer Privacy Act (“CCPA”) as amended by the California Privacy Rights Act, and applies only to California residents. Information set forth in this Disclosure may duplicate what is set forth elsewhere in this privacy policy. Any terms defined in the CCPA have the same meaning when used in this Disclosure.
This Disclosure is effective as of July 15, 2024.
The personal information (“PII” for purposes of this section) that we collect and the manner we use it is covered in the sections above.
A. Categories. Below is a summary for the preceding 12 months of the personal information categories (as identified and defined by the CPPA) that we collected in the course of providing our clients with campaigns and services, indicated by a “Yes” in the ‘Identify if Processed’ column:
B. Categories Shared. We may use or disclose PII in the following categories in the course of providing our clients with promotions and services (the “Business Purpose Disclosures” in the table below).
C. No Sale. In the 12 months prior to the effective date of this Disclosure, Quikly has not sold (as the term “sell” is defined in the CCPA) your PII.
D. Right to Request Disclosure. You have the right to request, free of charge, that we disclose information about our collection and use of your PII over the past twelve (12) months, including:
The categories of PII we collect about you;
What PII we collect, use, or disclose about you;
The categories of sources of the PII we collect about you;
Our business or commercial purpose for collecting the PII;
For each category of PII, the categories of third-parties with whom it was disclosed; and
The specific pieces of PII we collect about you.
For more information on how to request information about our collection, use, and disclosure of your PII, please see the Submitting CCPA Requests section below.
E. Submitting CCPA Requests. Once we receive your request and verify your identity, we will review your request to see if an exception allowing us to retain the information applies. We will delete or de-identify PII not subject to an applicable exception from our records and will direct our service providers to take similar action.
F. Requests to Know or Delete. To exercise your rights to know or delete described above, you may submit a request by visiting our California Consumer Rights form, available at privacy.rtm.com, or by contacting us through the Contacting Us section below.
G. Verification of Requests. Only you, or an individual legally authorized to act on your behalf, may make a request to know, delete, or opt-out related to your PII. To designate an authorized agent, or to make a request on behalf of a consumer for whom you are an authorized agent, please submit verification documentation through our California Consumer Rights form, available at privacy.rtm.com.
You may only submit a request to know twice within a 12-month period. Your request to know or delete must: (1) Provide sufficient information that allows us to reasonably verify you are the person about whom we collected PII, or that the requestor is your authorized representative; and (2) Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We may request information from you in order to verify your identity. Additionally, we may require that authorized agents provide proof of their authorization. We cannot respond to your request or provide you with PII if we are unable to verify your identity, your authority to make a request on behalf of another person, or if we cannot confirm that the PII relates to you. In general, we will verify your request and your identity by matching the information you provided with the information we have in our records. We will only use PII provided in the request to verify the requestor’s identity or authority to make it.
Please note, if we have received your request in our role as a Service Provider, we will refer your request to the client.
H. Timing. We will use reasonable efforts to respond to your request within 45 days of receipt. If we require additional time, we will inform you of the reason and the extension period in writing.
I. Exceptions. We may deny your deletion request if retaining the PII is necessary for us to:
Complete the transaction for which we collected the PII;
Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;
Identify and/or repair errors that impair the functionality of our Services;
Make other lawful uses of the PII that are compatible with the context in which you provided it; and
Comply with a legal obligation.
J. Content. Any PII we provide you with will only cover the 12-month period preceding our receipt of your request. Once we receive your request, validate your identity (and unless one of the exceptions above apply) we will disclose to you:
The categories of PII we collected about you;
The categories of sources for the PII we collected about you;
Our business purpose for collecting that PII and whether it was sold;
The categories of third-parties with whom we shared the PII;
If we sold or disclosed your PII for a business purpose, we will provide you with information about those sales and disclosures along with the PII categories that were provided and each recipients category.
The specific pieces of PII we collected about you (also called a data portability request, as detailed below in Section K).
K. Data Portability. For data portability requests, we will select a data format that is readily useable and should allow you to transfer PII to another entity without difficulty.
L. No Charge. We do not charge a fee to process or respond to your PII request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
M. No Discrimination. Quikly will not discriminate against any person for exercising their rights under the CCPA.
Users under the age of 13 are not eligible to participate in Quikly Campaigns. We do not knowingly collect Personal Information from users under 13 years of age. If we learn that you are a child under the age of 13, we will disqualify you from the applicable Quikly Campaign and delete your data from our systems.

Quikly may make material changes to this privacy policy from time to time. Therefore, you should periodically visit this page to view the current privacy policy.
